OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND D.C., 18 YEARS AND OLDER

  1. HOW TO ENTER THE CONTEST: Beginning at 12:00 pm Pacific Time ("PT") on January 16, 2013 through 11:59pm Pacific Time on February 15, 2013 (the "Contest Entry Period"), go to www.brita.com/filter-for-good, click on the banner ad for the "Brita® Bottle Free Bands Contest", or go to britabottlefreebands.com and follow the onscreen instructions to register and submit an entry in the contest. Entry must include answers (in 1,250 characters or less each) to two questions asked about how your touring band would benefit from help from Brita® to make your tour "green". Answers must include detail on how you would plan to mobilize your fans to share your commitment to sustainability. Entry must also include both a photo and a link to a video your band has posted on YouTube that shows your band performing, doing an interview, or anything else creative the band would like to showcase. Photo must be in one of the following file formats: JPG or GIF and must not exceed 1MB in file size. Video must be in one of the following file formats: 3G2, 3GP, AVI, F4V, FLV, M4V, MOV, MP4, MPG, PEG, QT, WMV, must not exceed 100MB in file size or two minutes in length. Your photo and video will not be judged; however they will be posted along with your essay if your band is determined to be a Finalist band. Music can only be used in the video if it is an original composition created by the entrant/band. If any individuals appear in the photo or video other than the Entrant, or if any footage of any venues/locations is featured, Entrant must have the permission of the individuals, including all band members and others, (or their parent's or legal guardian's permission if individuals are minors in their state of residency) and the permission of the venues/locations to use the audio and visuals of everyone and every place that is featured in the photo and video in any and all media without compensation. Proof of such permission may be required at Sponsor's discretion. Submission of any Entry/essay/photo/video further constitutes the Entrant's consent to grant the Sponsor certain rights in and to the Entry/essay/photo/video, as described in Rule 6, below. Each Entry submitted must meet all entry requirements. There is a limit of one (1) entry per email address/person/band. Entry must be made in Entrant's name only, regardless of whether others contributed to or appear in or are mentioned in the Entry/essay/photo/video. Entries that are lost, late, incomplete, illegible or corrupted are void and will not be accepted. Entries that are found to contain content plagiarized from other websites and/or publications will be void and will result in disqualification. Entry must be Entrant's (and his/her bandmates) original work.

    ENTRY GUIDELINES: Entry cannot: (a) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain or reference nudity or any materially dangerous activity (b) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (c) be obscene or offensive, endorse any form of hate or hate group; (d) contain or reference trademarks, logos (except Sponsor's) or trade dress owned by others, or advertise or promote any brand or product (except Sponsor's) of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; (e) contain copyrighted or licensed materials owned by others without permission including branded product placement, branded logos, use of branded content in dialogue, celebrity name and likeness and licensed music content (unless filmmaker independently secures rights to included content). Filmmakers must provide documentation for usage right, etc. as applicable; and (f) contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission. By submitting an Entry you warrant and represent that: (a) it has not been previously published; (b) it has not received previous awards; (c) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (d) the other participants depicted in the Entry, if any, have given written consent to its submission into the contest and use as contemplated by these Official Rules; and (d) publication of the Entry via various media including Web posting and posting in social media, will not infringe on the rights of any third party. Entrant will indemnify and hold harmless Sponsor from any claims to the contrary. Any Entry that, in the sole opinion of Sponsor, is deemed to be inappropriate for publication or inclusion in the contest for any reason will be disqualified from the contest. Filmmakers may use the Brita® product within their films where relevant, however product usage is not required. Films should make no marketing or product claims associated with The Clorox Company or Brita®.

  2. JUDGING/CONTEST WINNER DETERMINATION: Phase 1: All eligible entries will be judged by a panel of expert judges based on the following criteria: Creativity/Originality (34%), Quality of Submission (33%), and how well the Entry fits the Brita-Filter-Good theme. Phase 2 Consumer Voting: The top thirty (30) highest scoring entries at the conclusion of Phase 1 Judging will be deemed Finalists and will be posted online at www.brita.com/filter-for-good beginning at 12:00 pm PT on March 12, 2013 through 11:59 pm PT on May 1, 2013 (the "Voting Period"). Individuals who are legal residents of the 50 U.S. and D.C., 18 years and older, can visit www.brita.com/filter-for-good during that time period, register and then vote for their favorite entry. Sponsor reserves the right to post less than thirty Finalists online. Limit one vote per email address/person per day. The Contest Finalist Entry with the most votes at the conclusion of Phase 2 Consumer Voting will be the Grand Prize winner. All Finalists will receive a First Prize. In the event of a tie during judging, tied entries will be re-evaluated and the winner will be determined on the following criteria: Phase 1: Creativity/Originality (100%) and Phase 2: highest score from Phase 1. Sponsor reserves the right to select an alternate Potential Winner should the voting appear to have been tampered with or manipulated in any way. Restrictions: Use of script, macro or any other automated system to vote is prohibited and all such votes will be void. Entrants who are included in Round 2 are prohibited from obtaining votes for any Submission by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, vote farming, or any other activity that artificially inflates such Entrant's votes as determined by Sponsor in its sole discretion. Entrants are prohibited from sabotaging the votes of any Submissions through any means deemed inappropriate by Sponsor, in its sole discretion. If an entrant or voter engages in any of the aforementioned acts, his/her votes will be void, and his/her Submission (if any) will be disqualified. Blog and social media posts by the entrant about his own entry are permitted. Prize award is subject to verification of eligibility.

  3. ELIGIBILITY: Open to legal residents of the 50 United States and D.C., who are members of a touring band (defined as a band that has a published tour schedule and performs at least five (5 dates per year), 18 years of age or older at time of entry, except employees, officers, directors and agents of The Clorox Company ("Sponsor"), Promotions.com, LLC ("Judges"), TPN, REVERB, South x Southwest, Sundance Film Festival, Matter, and their respective parents, affiliates, subsidiaries, sales representatives, wholesalers, distributors, printers, and advertising and promotion agencies (collectively, "Promotion Parties"), and members of the immediate families (parent, child, sibling and spouse and their respective spouses, regardless of where they reside) and households of each, whether related or not related, who are not eligible to participate or win a prize in the promotion. Void where prohibited. Promotion is subject to all applicable federal, state, and local laws.

  4. PRIZES AND APPROXIMATE RETAIL VALUES ("ARVs"): One (1) Grand Prize: Prize includes a consultation with REVERB who will provide the band with ideas on how to create a "green" tour; 2,000 Nalgene bottle with the band's logo; consultation on fuel coordination, local food sourcing and catering, Recycling stations, Carbon offset, and PR and social media; and $4,500 in cash awarded in the form of the check made payable directly to winner named on the entry form. ARV: $19,500. Thirty (30) Finalists First Prizes: development and provision of a Sustainability Rider that winning band may give to the venues they play at to help create a "green tour"; 200 Nalgene bottles with the band's logo; Brita® pitcher; consultation on Carbon offset; and provision of information regarding Green merchandise sources. ARV: $30,000. Total ARV of all prizes is $49,500. No substitutions, cash equivalents, or transfers of prizes permitted by winners. Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. All prize details are at Sponsor's sole discretion. Limit one (1) Prize per person/band. All federal, state and local taxes as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the responsibility of winners. Inclusion of the band's logo on Nalgene bottles is subject to legal clearance.

  5. Winner Notification: Potential Grand and Finalist Prize winners will be notified by e-mail/mail and/or telephone and will be required to sign and return an Affidavit of Eligibility, Release of Liability and a Publicity Release within five (5) days of attempted delivery or prize will be forfeited. All members of the Grand and Finalists bands will be required to sign and return a Publicity Release Form prior to prize award. Failure to claim the prizes as instructed, the return of any prizes/prize notifications as undeliverable, Sponsor's inability to contact a potential winner in a reasonable time period, or non-compliance with these Official Rules may result in forfeiture of prize and an alternate winner determined.

  6. GENERAL RULES: By participating, participants accept and agree to these Official Rules and the decisions of the Sponsor and Judges, which shall be final and binding in all matters. By participating, participants agree to release and hold Promotion Parties harmless against any and all claims and liability arising, in whole or in part, directly or indirectly, out of participation in the contest or use or redemption of a prize. By submitting an entry, entrant agrees to have his/her name and entry (including essay/photo/video) used for advertising and marketing and other purposes in any and all media now and hereafter devised, worldwide in perpetuity, without further compensation, notification, permission unless prohibited by law. Acceptance of a prize constitutes permission to the Sponsor and its designees' to use winners' names, likenesses, submitted entry (including essay/photo/video) (and biographical information) for advertising and marketing and other purposes in any and all media now and hereafter devised, worldwide in perpetuity, without further compensation, notification, permission unless prohibited by law. Promotion Parties are not responsible for lost, late, incomplete, misdirected, garbled, stolen, inaccurate, damaged, undelivered or delayed entries, game plays, prize claims or emails; or for technical, hardware or software malfunctions, lost or unavailable network, cable, satellite, Internet Service Provider (ISP) connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this promotion, or for any errors, problems or malfunctions of any kind whether caused by computer, network, technical, mechanical, printing, typographical, or by any human error or otherwise which may occur in the programming of this promotion, including, without limitation, errors, problems or malfunctions which may occur in connection with the administration of the contest, the processing of entries or prize claims, the announcement of the prizes or in any promotion-related materials. Promotion Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the promotion. Promotion Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participation in this promotion or downloading materials from or use of the web site. If, in the Judges' opinion, there is any suspected evidence of tampering with any portion of the promotion, or if virus, bugs, non-authorized human intervention, technical difficulties or other causes compromise the integrity, administration or conduct of the promotion, the Judges reserve the right to modify or terminate the promotion in a manner deemed reasonable by the Judges, at the Judges' sole discretion. In the event a dispute arises as to the identity of a potentially winning online participant, entries made by internet will be declared made by the name on the online registration form. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

  7. CONDITIONS AND LIMITS OF LIABILITY: As a condition of participating in this promotion, each participant agrees: (1) under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental and consequential damages, and any other damages, other than for actual out-of-pocket expenses as set forth in subsection 3 below, and any and all rights to have damages multiplied or otherwise increased; (2) this promotion is governed by the laws of the State of California without regard to its conflicts of law principles and any and all disputes, claims and causes of action arising out of or connected with this promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively before a Court of competent jurisdiction located within the State of California; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred in participating in this promotion and in no event will participant be entitled to receive attorneys' fees, or any other costs; and (4) participant shall be bound by these Official Rules.
